Can a subpoena be fought?

I've been going to games since August 8, 1973....and on August 22, 2004, finally, a foul ball came my way. I had to reach for it, and it deflected off the tip of my right index finger. Shoot, if I was only 4 inches taller!

On what grounds would a fight win?

I don't know what grounds it can win on, but doesn't congress have better, more important things to do than find out if someone used steroids?

According to what I heard this AM, Congress just wants to be the light for baseball on steriods because they feel that sunshine the best disinfectant.

I'm starting to think that it couldn't hurt.
But, then, when the next work stoppage happens, it would be great if Congress gets involved then too.

Red face

This is really dumb. Aren't you supposed to be innocent until proven guilty? Is Congress going to set a bad precedent here, at the same time encouraging people like Canseco to write sensational (and probably partly fictionalized) tell-alls? Will any athlete actually say "yeah, I used steroids" live on C-Span? Why pick on just these guys? Because they were named in a book? Is that fair? What about the time they miss in spring training, while other guys get their cuts in?

Blech. Keep the government out of it, I say.

The stupid thing I wonder: Who pays for getting these guys there? And their meals? And their legal fees? Can Congress make someone spend thousands of dollars just because they want to ask them questions? Or, does the government cover the costs on this for anyone they demand come testify?

Shouldn't they wait for the BALCO trial to be over? Maybe Congress should track down how secret documents kept getting leaked to the press first

"The audacity, the legal audacity of subpoenaing someone who's
been a grand jury witness before there's been a trial in the

FWIW, Stanley Brand got killed on the M&M ESPN Radio show this AM. He really came off as clueless.

Bud should have hired Boras.

There was a problem with Brand's quote. The right to privacy (1) is not a First Amendment and (2) a real dubious argument to assert in this case.

Nevertheless, given the current conservative judicial bench's views on congressional power, MLB's got a shot to get the subpoenas quashed. I won't say it's likely. I'd say the odds are more in favor of them losing. But, this is the kind of case where if you get the right judge, you can prevail.
