Piercing, tattoos create U.S. workplace issues

CHICAGO, June 22 (Reuters) - Ron Carter's Starbucks' Coffee uniform includes pants, a shirt, an apron -- and wristbands to hide his coffee connoisseur customers from the tattoos on his arm.

The drawings are "nothing serious, no gang emblems or anything," said Carter, a coffee taster for several Starbucks restaurants in Chicago. One of the tattoos is the word "Janet" -- Carter is a fan of pop star Janet Jackson -- the other is Sanfok, a form of African tribal art.

His case is not unusual in the U.S. workplace, where the popularity of body piercing and tattoos is posing a challenge to the dress codes of many employers.

While Carter would like Starbucks' appearance guidelines to be more relaxed, he understands the company's reasoning.

"I just take it as a protocol," he said. "It's a business."

Chris Gimbl, a spokesperson for Starbucks Corp. <SBUX.O>, said employees generally see the chain is trying to present a clean, neat environment and are willing to adhere to its policies.

A few employees have been terminated for refusing to remove piercings or cover tattoos, Gimbl said.

Starbucks requires employees to cover all tattoos and remove certain piercings. Carter has obliged for seven years, since he began work for the Seattle-based coffee seller.

DRESS CODES LEGAL

Under the law, if Carter wants to work at Starbucks, he does not have a choice. Employers are allowed to impose dress codes and appearance policies as long as they do not discriminate on race, color, religion, age, national origin or gender said Diane Amos, a public affairs specialist at the Equal Employment Opportunity Commission.

Still, as the number of pierced and tattooed employees has grown, so have the numbers of employees challenging the legality of appearance policies, said Ethan Winning, a human resources consultant who has been retained by companies in more than a such dozen lawsuits.

"I've never known an employee to win a case and I've never known a company to lose a case," Winning said. "The employer can set a reasonable standard for dress as long as it doesn't discriminate."

Specific and consistent appearance codes are less vulnerable to discrimination lawsuits, said human resources consultant Lynne McClure. She has acted as a mediator between companies and employees in several appearance policy disputes.

"Our whole society has become very lawsuit happy," McClure said. "I think companies are very vulnerable as people get more aware of the whole diversity issue. Companies need to be consistent with the dress codes they impose and consistent about enforcing them."

Wal-mart Stores Inc. <WMT.N> has developed specific policies regarding piercing and tattoos "as the culture has evolved and issues have come up," said Tom Williams, a spokesperson for the company -- the largest U.S. nongovernmental employer.

Wal-mart does not allow facial jewelry, specifically eyebrow, nose and lip piercing. It also requires earrings and hair color, on both men and women, to be "conservative." Employees with "offensive" tattoos must agree to keep them covered.

Appearance has an impact on both employee performance and customer perceptions, according to Williams.

COMFORT FACTOR

He said the policies exist because they help customers feel comfortable. "So when they come shopping it is a pleasant experience for them," he said.

But employers need to consider whether a piercing or a tattoo is worth the expense of a lawsuit or training a new employee, McClure said.

"In today's marketplace there are more jobs than there are people," McClure said. "I usually think it is best for companies to keep the ones (workers) they got."

But some employers, including Sears, Roebuck and Co. <S.N>, the No. 2 U.S. retailer, and Ameritech Corp., a telephone service provider that is a unit of SBC Communications Inc. <SBC.N>, said safety concerns obligate them to strictly enforce the company dress code. Loose jewelry can become entangled with equipment, they said.

Ameritech recently suspended three employees without pay for refusing to remove facial piercings.

"Its wearing suitable clothing for the type of work that is going to be done," said Denise Koenig, a spokesperson for Ameritech. "We make evaluations based on safety all the time."

This is American hypocrisy at it's finest...I live this issue every day of my life and it really sucks. (But yes, I know it was my choice)
I had a job once that threatened to fire me if I didn't cover a tattoo (even though they knew I had it when I was hired and never said a word about it until I hit the sales floor), needless to say, I threatened to sue for discrimination and they backed off, and I did cover it after that, just out of respect for their wishes...but they should have said something from the beginning...none of this "We'll make the rules up as we go along" crap. It's irritating. I know that there are certain situations where certain company requires a little more discretion and being "presentable" and all that crap, but personal freedom is still personal freedom...maybe this guy should go find a different job...that's always the best option.

Let your freak flag fly...and ain't NOBODY tellin' me to cover up my Yankee tattoo! :D Heehee!

Well, I'm gonna tell ya because I know how much I hate wondering about things...it's at the base of my neck, between my shoulders. I can PROUDLY show it off (all summer long, at least)...in fact, just last night I went to see Yes and got a few compliments on it. :) It's cool being a baseball chick. :D

BUZZ! Drag Mexi on a plane and come visit! We'll go play Keno until we puke on all the 25 cent beers! Heehee! :) Don't be jealous, I'm unemployed and getting bored. The weather's beautiful though, can't complain about that. I just ventured over to the New York, New York casino yesterday, it reminded me of NYC very vaguely (no knishes!), but hey, I guess if New York was ever Disney-fied, this is what it would be, right?
Satchel, thanks for asking, the show was GREAT!!! I just love Yes and wish they would've played all night. They played for about 3 hours, it was awesome...outdoors, under a half moon and stars, watching the airplanes line up for landing over the stage...sigh. :) They had a 20 piece orchestra backing them up, it sounded killer. John Anderson's voice NEVER changes and they have some new guy (???) on keyboards who hooked up with them in Jersey, he's really good (and really young).
I was hoping to hear Starship Trooper because it's my favorite and they did play it and dragged it out for what seemed like an eternity so I was thrilled. :) They played alot of older stuff (what a treat!) and only a few new ones (not too bad!) and they did a Battle of the Drums at one point with them all banging away, it was cool. :) If they play near you, I definitely suggest going to see them. :)
I'm going to see The Cult next week, can't wait! (That's another bad thing about this town, there's always so many things I want to see and do, and with a very limited income right now, it's a toss up between groceries or concert tickets...not a real tough choice for me, I guess!)

Man, do I miss you guys terribly.
Net...glad I'm not the only one who gets Cult songs stuck in their head...but for me, it's Electric Ocean...GOD I've been singing that song for DAYS now!!! "The place to be-eee, Electric SEAAAA"...ya know, I love them and all, but that song is now driving me bonkers! The show's tonight, I can't wait!!! (Maybe I'll get rid of this stuck song???)
And Buzz, yes, it is highly achievable to drink for free in this town, but I prefer to spend my time with the old farts at the "locals" hang-outs, where the beers are CHEAP, but not FREE. I love hearing the "back in the day" stories from these people, they're a real riot! It's so funny how one gets a quick aversion to midwestern tourists in plaid shorts with poofy hair...let them drink for free, because they AREN'T drinking for free. I just read an article in yesterday's paper about how 5 of the major casinos in town "won" over $6 BILLION from gamblers last year...you call that free drinks? Me thinks not.
Anyway, I'm JONESIN' SO BAD for some BASEBALL I could just scream!!!!!! I see nothing here...it's unbearable. And I'm still not used to the time change, either. The games are over by 7 p.m...but I'll manage...somehow. (Read: Cheap beers! Heehee!)

I heard you made a recent appearance here on Netshrine. How the heck are ya'?!?! I haven't been frequenting the Shrine much lately, but somewhere I thought I read you were coming East...? Well, glad to see you surfaced. Do me a favor and go into the Las Vegas Club, sit down and order yourself a few beers. You don't even need to tip the chick who brings it to you. I didn't get back in beverages what I lost there last time, so they owe me quite a few. :cheers:

Sure Mexi, I'll go to the Vegas Club for ya, and don't worry about not tipping, I have very strong feelings about tipping and anymore, these "service industry professionals" have an attitude that they are ENTITLED to a tip instead of EARNING one so I say "Go scratch yer ass"...heehee! I am by no means CHEAP, just very bullheaded about who I give my money to, ya know? I expect SERVICE. (Jeez, I'm starting to sound like my grandfather!) And yeah, I was headed east...it pays to look at the Atlas right side up. ;) It's a LONG story...suffice it to say, Vegas is THE town for transients.
And Buzz, I did what you said a couple days ago and the Yankees made me lose some money and I wasn't too happy about that...I have learned a valuable lesson...don't ever bet on rookie pitchers. Damn Lilly!!! :p :nono: I think I need to do that at least once a week though...all I can get on the tv is Braves (Damn Ted Turner!) and occassionally D'Backs...it sucks. And there's all this talk again about Vegas acquiring the A's and that's NEVER going to happen so I wish they'd shut up about it already...they were saying the same thing when I was here 6 years ago...guess there's no new news in a dustbowl.
